DMCA Copyright & Intellectual Property Protection Policy
Gomen maintains an unyielding commitment to upholding intellectual property rights and complying fully with the statutory mandates of the Digital Millennium Copyright Act of 1998 (Title 17, United States Code, Section 512, hereinafter referred to as the “DMCA”), the European Union Directive on Copyright in the Digital Single Market, and international intellectual property conventions administered by the World Intellectual Property Organization (WIPO).
It is our steadfast operational policy to respond expeditiously to legitimate notices of alleged copyright infringement, to thoroughly investigate substantiated legal notifications, and to implement immediate remedial actions, including the prompt removal or disabling of public access to any software package, graphic asset, or editorial content found to be in violation of applicable copyright statutes.
1. Fundamental Disclaimer of Trademark & Proprietary Ownership
All trademarks, registered service marks, commercial brand names, trade dress, product titles, and corporate logos displayed throughout Gomen are the sole and exclusive property of their respective legal owners and originating developers. The presentation of third-party trademarks, including but not limited to Android, Google Play, and specific publisher brand insignias, is conducted strictly for transformative, nominative, descriptive, and informational identification purposes.
Unless explicitly declared otherwise, Gomen is an independent software archive and discovery portal. We are not affiliated with, authorized by, sponsored by, or endorsed by Google LLC, Android Open Source Project, or any third-party software manufacturer cataloged within our repository. Any reference to specific software packages, commercial products, or proprietary service marks does not constitute an endorsement, sponsorship, or collaborative association.
2. Role as an Independent Indexing & Software Mirroring Service
Gomen operates within the statutory safe harbor protections established under 17 U.S.C. § 512(c) and applicable international electronic commerce regulations. Our service functions primarily as a digital indexer, mirror repository, and discovery conduit for publicly distributed software packages originally compiled and authorized for public distribution by their respective authors.
We do not publish, host, or disseminate software circumvention tools, digital rights management (DRM) cracks, modified commercial cheats, or unlicensed iterations of paywalled software. All applications indexed on our platform represent original, unmodified binaries cryptographically signed by their legitimate development houses. Nevertheless, we recognize that intellectual property owners may occasionally seek to modify their digital distribution channels or restrict independent mirroring.
3. Formal Statutory Requirements for DMCA Infringement Notifications
To enable our legal compliance team to execute swift and decisive investigation, any formal notification of claimed copyright infringement submitted to Gomen must strictly comply with the requirements codified at 17 U.S.C. § 512(c)(3). Incomplete submissions lacking statutory elements will result in processing delays. Your written communication must include the following explicit elements:
- Physical or Electronic Signature: A physical or verifiable electronic signature of a person authorized to act on behalf of the owner of an exclusive copyright right that is allegedly infringed.
- Identification of the Copyrighted Work: A clear, exhaustive description of the copyrighted work claimed to have been infringed. If multiple copyrighted works residing on a single online site are encompassed within a single notification, provide a comprehensive, representative catalog of such works.
- Precise Location Identification (Exact URLs): Direct, exact URL links pointing to the specific webpage or download gateway on Gomen where the allegedly infringing material is hosted or made accessible. General domain references (e.g., “search your database for our game”) are legally insufficient under federal statutory guidelines.
- Contact Information of the Claiming Party: Comprehensive contact details enabling our compliance department to establish prompt communication with you, including your legal name, corporate title, physical business address, direct telephone number, and official corporate email address.
- Statutory Statement of Good Faith Belief: An unambiguous statement declaring: “I have a good faith belief that use of the copyrighted material in the manner complained of is not authorized by the copyright owner, its legal agent, or the law (such as fair use).”
- Statutory Statement of Accuracy Under Penalty of Perjury: A solemn declaration certifying: “I hereby swear, under penalty of perjury pursuant to the laws of the United States of America and applicable international jurisdiction, that the information set forth in this notification is accurate, and that I am the copyright owner, or am legally authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.”
4. Takedown Workflow, Response Timelines & Remedial Protocols
Upon receipt of a valid, fully substantiated DMCA takedown notification conforming to the six criteria outlined above, Gomen initiates our accelerated compliance protocol:
- Verification & Intake: Our designated copyright agent reviews the notice within twenty-four (24) business hours of electronic receipt to verify legal standing and confirm the specific URL locations identified.
- Access Termination: Upon confirmation of a legitimate claim, our systems automatically invalidate public download links, decouple content delivery network caches, and restrict public accessibility to the designated application package.
- Originating Party Notification: In accordance with statutory safe harbor provisions, our team makes reasonable, good-faith efforts to notify the application uploader or verified developer account holder regarding the enforcement action, providing a complete copy of the infringement notification.
- Audit Logging: All received DMCA notices, communication logs, and associated hash records are permanently archived within our internal legal compliance ledger for auditing and transparency reporting.
5. Counter-Notification Procedures Pursuant to 17 U.S.C. § 512(g)
If an affected content publisher or developer maintains a good-faith belief that material removed or disabled as a result of a DMCA notice was targeted through mistake, misidentification, automated error, or fair use authorization, the uploader may submit a formal Counter-Notification to our Designated Agent pursuant to 17 U.S.C. § 512(g)(2) & (3).
To be effective, a Counter-Notification must be a written communication including: (a) physical or electronic signature of the uploader; (b) identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed; (c) a statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification; and (d) the subscriber’s name, address, and telephone number, alongside consent to federal court jurisdiction in the judicial district of their residence, or if outside the United States, any judicial district in which the service provider may be found.
Upon receipt of a valid counter-notification, Gomen will promptly forward a copy to the original complaining party. If the copyright claimant does not notify our agent within ten to fourteen (10-14) business days that an action has been filed in federal court seeking a court order to restrain the subscriber from engaging in infringing activity, Gomen is statutorily authorized to restore access to the contested material.
6. Repeat Infringer Termination Policy
In strict accordance with 17 U.S.C. § 512(i)(1)(A), Gomen enforces an uncompromising repeat infringer policy. Accounts, developer profiles, and submission privileges belonging to any individual, entity, or automated system that repeatedly submits unauthorized, infringing, or copyright-violating software will be permanently revoked. Our automated risk engine maintains cryptographic developer certificate blacklists and IP telemetry bans to preclude bad-faith actors from re-entering our distribution channels.
7. Caution Against Fraudulent or Bad-Faith Claims (17 U.S.C. § 512(f))
Please be advised that under 17 U.S.C. § 512(f), any individual or organization who knowingly materially misrepresents that online material is infringing, or that material was removed or disabled by mistake or misidentification, may be held liable for statutory damages, including substantial court costs and attorney fees incurred by the alleged infringer, copyright holder, or service provider. Do not submit spurious or unverified claims if you do not own the contested intellectual property.
