Terms of Service & User Usage Agreement

Welcome to Gomen. These Terms of Service (hereinafter referred to as the “Agreement” or “Terms”) represent a legally binding contractual covenant entered into between you (either as an individual visitor or on behalf of an entity, hereinafter referred to as “User,” “you,” or “your”) and Gomen (hereinafter referred to as “the Platform,” “we,” “us,” or “our”), governing your access to and utilization of the website located at https://gomen.my, including all software directories, download gateways, APIs, editorial reviews, and technical services provided herein.
BY ACCESSING, BROWSING, OR UTILIZING THIS PLATFORM, YOU UNEQUIVOCALLY ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND CONSENT TO BE FULLY BOUND BY ALL PROVISIONS SET FORTH IN THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS IN THEIR ENTIRETY, YOU MUST IMMEDIATELY CEASE ACCESSING AND UTILIZING OUR PLATFORM.
1. Eligibility & Capacity to Contract
Access to and utilization of Gomen is strictly contingent upon your legal capacity to enter into binding agreements. By accessing this platform, you affirm and warrant that you are at least thirteen (13) years of age (or sixteen (16) years of age within European Union member states), and that you possess the full legal right, power, and authority to enter into this Agreement. If you are accessing the Platform on behalf of an enterprise, organization, or corporate entity, you represent and warrant that you are duly authorized to bind such entity to these Terms.
2. Nature of the Service & Digital Distribution Model
Gomen operates exclusively as an open-access, independent software discovery portal, technical archive, and indexing service for Android application packages. Our technical infrastructure facilitates the discovery and direct downloading of original, unaltered Android packages (APK and XAPK binaries) compiled and distributed by independent software developers and commercial studios worldwide.
Unmodified Binary Commitment: We commit that all APK binaries indexed within our catalog represent authentic, bit-for-bit copies carrying original cryptographic signatures matching developer certificates. We do not inject unauthorized code, modify software binaries, decompile application logic, or bypass software licensing models. Users acknowledge that Gomen acts as a passive distribution conduit and is not the author, manufacturer, or copyright holder of third-party software cataloged on the site.
3. Permitted Uses & Personal Backup License
Subject to ongoing compliance with these Terms, Gomen grants you a personal, revocable, non-exclusive, non-transferable, and limited license to access, view, and download cataloged software packages strictly for your own personal, non-commercial informational and file-archival backup purposes. You may use our download gateways to obtain legitimate copies of software for installation on your personal Android-compatible hardware.
4. Strictly Prohibited Conduct & Platform Integrity
The integrity, security, and sustained availability of Gomen depends upon responsible platform usage. You expressly covenant and agree that you shall not, under any circumstances, engage in or facilitate any of the following prohibited behaviors:
- Automated Scraping & Extraction: You shall not deploy automated web crawlers, spider bots, scraping routines, offline readers, or automated extraction scripts to systematically scrape, harvest, index, or mirror our software directory, editorial reviews, or API endpoints without prior express written authorization.
- Denial-of-Service & Infrastructure Attacks: You shall not initiate, execute, or participate in any distributed denial-of-service (DDoS) attacks, automated high-frequency request floodings, server stress testing, or any action that imposes an unreasonable or disproportionately large burden on our computing hardware or network bandwidth.
- Security Bypass & Vulnerability Probing: You shall not probe, scan, or test the vulnerability of our platform, circumvent security headers, manipulate token parameters, attempt to bypass CSRF safeguards, or decompile our backend administrative infrastructure.
- Distribution of Malicious Payloads: You shall not submit, upload, or transmit software packages, comments, contact forms, or communications containing viruses, trojans, ransomware, spyware, keyloggers, or other malicious computer code designed to disrupt, damage, or compromise device security.
- Circumvention of Intellectual Property Protections: You shall not utilize our platform to solicit, upload, or disseminate software circumvention utilities, serial key generators, license bypasses, or digital rights management (DRM) stripping utilities.
- Impersonation & Fraudulent Representation: You shall not misrepresent your identity, impersonate any corporate entity or developer, submit fraudulent DMCA notifications, or falsely claim affiliation with Gomen.
5. Intellectual Property Rights & Third-Party Trademarks
Platform Ownership: All proprietary software, custom code, dynamic themes, layout designs, user interface components, editorial articles, custom graphics, and database architectures created by Gomen are the exclusive intellectual property of Gomen and are protected under international copyright, trademark, and trade secret statutes.
Third-Party Intellectual Property: All third-party software applications, package names, trademarks, developer names, and registered logos indexed on this site remain the exclusive property of their respective originating authors and copyright holders. Mention or display of third-party trademarks on our platform is conducted strictly under descriptive, nominative fair use doctrine to accurately identify compatible software for consumers. Gomen asserts zero proprietary claim over third-party software titles.
6. Warranty Disclaimer (“AS IS” and “AS AVAILABLE”)
TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, THE SERVICES, WEBPAGES, CONTENT, DOWNLOAD MIRRORS, AND ALL THIRD-PARTY SOFTWARE ACCESSED THROUGH Gomen ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, Gomen EXPLICITLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT:
- THE PLATFORM WILL OPERATE UNINTERRUPTED, TIMELY, SECURELY, OR FREE OF DEFECTS OR ERRORS;
- THIRD-PARTY SOFTWARE PACKAGES DOWNLOADED VIA OUR MIRRORS WILL EXECUTE FLAWLESSLY ACROSS ALL HARDWARE CONFIGURATIONS, CUSTOM ANDROID ROMS, OR OS VERSIONS;
- ANY DEFECTS, BUGS, OR SERVER LATENCIES WILL BE IMMEDIATELY REMEDIED; OR
- THE PLATFORM IS FREE OF MINOR TRANSMISSION ERRORS OR TEMPORARY MIRROR DROPS.
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR INSTALLATION AND EXECUTION OF ANY ANDROID APPLICATION OBTAINED THROUGH OUR SERVICES IS CONDUCTED AT YOUR SOLE VOLITION AND DISCRETION, AND THAT YOU ASSUME COMPLETE RESPONSIBILITY FOR ANY DEVICE MALFUNCTION, STORAGE LOSS, DATA CORRUPTION, OR SYSTEM INSTABILITY THAT MAY RESULT THEREFROM.
7. Comprehensive Limitation of Liability
TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE JURISDICTIONAL STATUTES, IN NO EVENT SHALL Gomen, ITS AFFILIATES, OPERATORS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE HELD LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES WHATSOEVER.
THIS EXCLUSION ENCOMPASSES, WITHOUT LIMITATION, DAMAGES FOR LOSS OF COMMERCIAL PROFITS, REPUTATIONAL DAMAGE, LOSS OF GOODWILL, CORRUPTION OF DIGITAL ASSETS, DEVICE BRICKING, WORK STOPPAGE, SYSTEM DOWNTIME, OR ANY FINANCIAL INJURY ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE OUR WEBSITE, EVEN IF Gomen HAS BEEN EXPRESSLY INFORMED OF THE POSSIBILITY OF SUCH INJURIES.
IF, NOTWITHSTANDING THE FOREGOING RESTRICTIONS, Gomen IS FOUND TO BE LIABLE UNDER ANY JUDICIAL CAUSE OF ACTION, OUR AGGREGATE CUMULATIVE LIABILITY UNDER THIS AGREEMENT SHALL UNDER NO CIRCUMSTANCES EXCEED THE AMOUNT PAID BY YOU TO Gomen IN THE PRECEDING TWELVE (12) MONTHS, OR FIFTY UNITED STATES DOLLARS ($50.00 USD), WHICHEVER IS LESS.
8. User Indemnification Obligations
You agree to defend, indemnify, and hold harmless Gomen, its operational entities, officers, partners, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees and legal costs) arising out of or directly related to: (a) your access to or unauthorized utilization of the Platform; (b) your violation of any provision of these Terms of Service; (c) your infringement of any third-party intellectual property, privacy, or proprietary right; or (d) any willful misconduct or negligent act perpetrated by you through our services.
9. Hyperlinks to Third-Party Websites & Ecosystems
Our website contains hyperlinks directing users to external third-party digital environments, including the official Google Play Store, developer support domains, and authorized distribution channels. These links are provided solely as a convenience to our visitors. Gomen exercises zero operational control over external websites, and we assume zero responsibility for the content, privacy policies, practices, or security standards of third-party domains. Your engagement with external sites is governed exclusively by their respective terms and policies.
10. Termination & Access Revocation
We reserve the unconditional unilateral right, without prior notification or liability, to suspend, terminate, or restrict your access to all or part of Gomen for any reason whatsoever, including without limitation your breach of these Terms of Service, abusive automated request behaviors, copyright violations, or malicious activity. All provisions of these Terms which by their nature should survive termination shall survive indefinitely.
11. Governing Law, Jurisdiction & Dispute Resolution
These Terms of Service and any dispute, controversy, or claim arising out of or related to your use of Gomen shall be governed by, construed, and enforced in accordance with the substantive laws of applicable commercial jurisdictions, without regard to principles of conflict of laws. Any legal action or judicial proceeding arising under this Agreement shall be instituted exclusively in competent courts of jurisdiction, and you hereby consent to personal jurisdiction and venue therein.
12. Severability, Entire Agreement & Waiver
If any clause or provision of this Agreement is held to be invalid, unlawful, or unenforceable by an arbitrator or court of competent jurisdiction, such provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms shall remain in full force and effect. The failure of Gomen to enforce any right or provision of these Terms shall not be deemed a waiver of such right.
